By registering a ScrapyDance account and registering on our website, you have accepted these terms and conditions (this "Agreement"). We reserve the right to modify this Agreement at our sole discretion from time to time, and such updated Agreement will take effect thirty (30) days after being posted on the website. We will notify you of such updates via website announcements or email, so you are advised to periodically review these terms and conditions. If you do not agree to any terms and conditions, please do not use or continue to use ScrapyDance; your use of the services will be deemed acceptance of the terms and conditions in effect at the time. By using our services, you also grant us the right to reasonably use your name and/or logo for promotional purposes on our website and other promotional materials.

7. "Headless Browser" refers to our headless browser service for automating web interactions.
8. Universal Scraping API refers to our service for bypassing website access restrictions.
9. "Proxies" refers to our proxy servers.
10. "Captcha Solver" refers to our captcha solving service.

The headings contained in this Agreement are for reference purposes only and shall not affect the meaning or interpretation of this Agreement.

Your Warranties, Representations, and Commitments

You warrant, represent, and covenant to us that:

1. You have obtained your entity's authorization to enter into this Agreement on behalf of your entity.
2. You have carefully read and fully understand the terms of this Agreement.
3. You have reached the legal age required to use our services in your jurisdiction.
4. All information and materials you provide to us are accurate, complete, non-misleading, and up to date.
5. To the fullest extent permitted by law, you shall be fully responsible for your use of our services and shall defend, fully indemnify, and hold us harmless from any and all claims, actions, damages, costs (including reasonable attorneys' fees), losses, or liabilities arising out of or related to your use of our services, except where such loss or claim is due to our negligence or willful misconduct.
6. You shall not share your account credentials with any person without our prior written approval. If we discover such sharing, we reserve the right to suspend your access to the services at our sole discretion.
7. You shall not engage in any prohibited activities described in these terms and conditions.
8. Your use of our services shall comply with all applicable laws and regulations.

License

Unless otherwise stated, ScrapyDance and/or its licensors own the intellectual property rights for all material on ScrapyDance. All intellectual property rights are reserved. You may access this from ScrapyDance for your own personal use subjected to restrictions set in these terms and conditions.

You must not:

• Republish material from ScrapyDance
• Sell, rent, or sub-license material from ScrapyDance
• Reproduce, duplicate or copy material from ScrapyDance
• Redistribute content from ScrapyDance

Certain parts of this website offer users an opportunity to post and exchange opinions and information in certain areas of the website. ScrapyDance does not filter, edit, publish, or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of ScrapyDance, its agents, and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. Each party agrees to keep the other party's Confidential Information confidential and not to disclose such Confidential Information to any third party without the other party's prior written consent.

"Confidential Information" means any and all information disclosed by one party ("Disclosing Party") to the other party ("Receiving Party"), in oral, written, or any other form, that is designated as confidential or that should reasonably be understood to be confidential given the nature of the information and the circumstances of disclosure.

The Receiving Party shall not use any Confidential Information of the Disclosing Party for any purpose except to the extent necessary to fulfill the purposes of this Agreement. The Receiving Party may disclose Confidential Information to the extent required by subpoena, judicial, or governmental request or order, provided that the disclosure is limited to the extent necessary under the circumstances, and the Receiving Party shall not be liable for such disclosure.

The Receiving Party shall take all reasonable steps to protect the confidentiality of the Disclosing Party's Confidential Information, including but not limited to using the same degree of care to protect such Confidential Information as it uses to protect its own Confidential Information of like nature.

The confidentiality obligations under this Agreement shall continue after the termination of this Agreement until such time as the Confidential Information no longer has the potential to negatively affect the Disclosing Party in any manner.

Linking to Our Content

The following organizations may link to our website without prior written approval:

• Government agencies
• Search engines
• News organizations
• Online directory distributors may link to our website in the same manner as they hyperlink to the websites of other listed businesses
• System-wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our website

These organizations may link to our home page, to publications, or to other website information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement, or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party's site.

We reserve the right to request that you remove all links or any particular link to our website. You approve to immediately remove all links to our website upon request. Subject to paragraph 1 of this section, our total liability to you under this Agreement shall be limited to the fees we have received from you under this Agreement.

Fees

Billing: We offer subscription-based payment models. Subscription package prices can be found on the Pricing section page. If your package subscription expires or has been fully used, you can choose to renew automatically or manually.

• Automatic Renewal: If you have enabled the automatic renewal option for your package, when the package expires or has been fully used, the system will automatically deduct your bound credit card to pay for the package price and renew the same package.
• Manual Renewal: If you have disabled the automatic renewal option for your package, when the package expires or has been fully used, you need to manually select the desired package for renewal and click the "Renew" button or re-order a new package. Once clicked, the system will automatically deduct the corresponding balance to pay for the package price and renew the package for you.
• If you have any specific requirements, you can also contact the staff for manual renewal.

Unused expired package portions are non-refundable. All payment methods can be selected from the payment options provided by ScrapyDance. ScrapyDance reserves the right to modify rates (including increasing rates) and payment terms at any time without notice to the customer. Modified rates and payment terms will take effect upon posting in the system.

Free Trial

ScrapyDance provides users with a certain amount of free usage. ScrapyDance reserves the right to modify the conditions for obtaining free trial credits. During this period, you can evaluate the service and decide whether to purchase.

You acknowledge and agree that you may only use the Service in accordance with the trial terms set forth in these Terms of Service and to the extent specified by ScrapyDance in your account and/or system.

Before starting the free trial, you need to register an account. Please note that the free trial option is only available to new users, and each user can only use the free trial credit once. Multiple accounts should not be created to obtain multiple free trial credits. We reserve the right to stop providing free trials if duplicate accounts are detected and/or blocked, and you will not be able to access any services provided during the free trial period. The company reserves the right to fully restrict access to the system.

Whether or not your free trial credit has been fully used, you can top up at any time during this period, and unused free trial credits will accumulate and be added to the top-up amount without disappearing.

Non-Refundable Situations:

Except when required by law, paid Subscription fees, credits, billed extra requests are non-refundable. Refund requests may be considered on a case-by-case basis and granted in sole discretion of ScrapyDance LLC.

Force Majeure

We are not responsible for any delay or failure in any part of the service due to reasons beyond our control. This includes but is not limited to: acts of God, changes in laws or regulations, embargoes, wars, terrorist acts, riots, fires, earthquakes, nuclear accidents, zombie apocalypse, floods, strikes, power blackouts, volcanic action, unusually severe weather conditions, and acts of hackers or third-party internet service providers.

Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach, termination, or validity thereof ("Dispute")shall be resolved according to the following dispute resolution procedure:

Any dispute arising from or related to this Agreement shall first be negotiated by appropriate personnel of each party with the authority to resolve the problem. Therefore, any dispute should first be submitted to ScrapyDance customer support at the following email address: anton@scrapy.dance.

Other Terms

This Agreement constitutes the entire agreement and understanding between the parties with respect to the subject matter hereof.
If any provision of this Agreement is deemed invalid, illegal, or unenforceable in any respect, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired. Any delay or failure by either party to insist upon strict performance of any covenant, obligation, agreement, or condition hereunder, or to exercise any right or remedy arising from a breach, shall not constitute a waiver of such breach or any other covenant, obligation, agreement, or condition.

Our Stance and Abuse Reporting

ScrapyDance's services strictly prohibit any user from engaging in purposes that infringe on the interests of others, including but not limited to cybercrime, cracking, and fraudulent activities. ScrapyDance is committed to helping startups use more powerful AI algorithms for SEO, ad verification, benign crawling, and other business growth scenarios, helping them save budget.

Report Abuse to Us - For Companies Being Infringed If someone is using our services in an illegal way to infringe on your interests, please contact us immediately. Once we verify that the case may be true, we will stop their service and provide the information we have, and make our best efforts to help you recover your losses.

Report Abuse to Us - For Anti-Bot Companies We hate cybercrime. If you are an anti-bot company and observe potentially fraudulent use that may come from one of our users, we will take this seriously. Please contact us immediately. If we verify that the case may be true, the business that committed such abuse will be immediately kicked out of our system and banned from any further interaction.

Compliance Statement

ScrapyDance strongly opposes illegal or non-compliant use of ScrapyDance services (including scraping API, headless browser, universal scraping API, proxies, and captcha solver) and will assist law enforcement agencies in investigating potential misuse of the ScrapyDance network. We reserve the right to block your access to our services at our sole discretion for compliance purposes, and you have no right to any form of compensation, liability, or damages for such blocking actions taken by us.

We have the right to conduct any "Know Your Customer" (KYC) (KYC) process we deem appropriate to decide whether to provide you with services. We reserve but do not assume the obligation to monitor your use of our services to verify that you are not engaging in any of the prohibited activities described below. We may share your information with third parties (such as authorities) without your consent in accordance with applicable laws and regulations.

In our KYC process, monitoring process, and other similar actions we take to verify the compliance status of your use of our services, you should fully cooperate and provide us with the required materials within a reasonable time.

It is strictly prohibited to use the ScrapyDance network for illegal, fraudulent, or abusive activities, and any such suspicious activity will be subject to appropriate investigation. If we believe that you may have engaged in or may engage in the prohibited activities described below, we have the right to suspend your right to access or use our services at our sole discretion and at any time.

Prohibited activities include (but are not limited to):

• Any form of DDoS attack.
• Any form of collecting non-public information on any website or other platform.
• Using our services in a way that poses a security risk to websites.
• Any form of spam: mass posting of any emails/comments/IRC messages and images.
• Any form of advertising fraud or click fraud.
• For impersonation or deceptive fraudulent purposes.
• Any form of abuse of our services.
• Any form of creating fake accounts or content.
• Any form of reselling ScrapyDance services.
• Any form of automated ticket purchasing activity.
• Any activity that may cause us to assume any form of liability.
• Any activity that may damage our reputation or goodwill.
• Other activities that violate any applicable laws and regulations, third-party rights, or any agreement between us.
